Owner shall remove 1,488 s.f. of hardcover from the 75-250' zone as indicated <br /> on Exhibit A attached. Final 75-250' hardcover is approved at a level of 6,752 <br /> s.f. or 24.3%, including approximately 35 s.f. of new decks to be constructed as <br /> shown on Exhibit A. The owner is advised that any future hardcover additions <br /> on the property which result in 75-250' hardcover of more than 25.0%, will be <br /> considered a violation of the zoning code unless a variance for such excesses is <br /> granted. ' <br /> 2. Owner shall obtain an after-the-fact building permit for the gazebo (no penalty <br /> fees will be assessed) and the inspection departrnent shall review the construction <br /> of the gazebo and may require any modifications necessary to bring that <br /> • structure into compliance with the building and fire codes. <br /> 3. Owner shall obtain a permit for the proposed deck additions as shown on <br /> � Exhibit A, prior to their construction. <br /> 4. Authorities granted by this variance run with the property not with the applicant <br /> or current owner, but are permissive only and must be exercised by application <br /> for a building permit within one year of the date of Council approval, or this <br /> variance will expire on that date (September 23, 1997). <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolutiori shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 6. The undersigned owner has read, understood and hereby agrees to the terms of <br /> this resolution and on behalf of himself, his heirs, successors and assigns, hereby <br /> agrees to the recording of this resolution in the chain of title of the property. <br /> � � ... <br /> Page 4 of 6 <br />
