Downey (hereinafter "the applicant") is the former owner of property located at 2675 <br /> Shadywood Road within the City of Orono (hereinafter "City") and legally described as <br /> follows: . <br /> • • Tract A, Registered Land Survey No. 1453, Files of Registrar of Titles, Hennepin <br /> County, Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant on behalf of the owner has applied to the City for <br /> a variance to Municipal Zoning Code Section 10.03, Subdivision 12 for an after-the-fact <br /> variance to permit the construction of a gazebo which is located less than the required 10' <br /> setback from the principal structure on the property. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2173. <br /> 2. The property is located in the LR-1B, Single Family Lakeshore Residential <br /> Zoning District. <br /> 3. The Orono Planning Commission reviewed this •application on September 16, <br /> 1996, and recommended approval of the proposed variance based upon the <br /> following findings: <br /> � Page 1 of 6 <br />
