LEHMAN , TO APPLY FOR A BUILDING PERMIT PRIOR TO FINAL SUB�IVISION APPROVAL WHEREAS, the Planning Commission and Council have reviewed and approved a preliminary subdivisionfor Edward T. Lehman, hereafter applicant , on June 13 , 1983 , and WHEREAS, the City has conditioned final approval of the subdivision upor. authorization of a sewer project that would serve three of the five lo�s within the subdivision; and � WHEREAS , the applicant hasfulfilled all of the conditions setforth at preliminary approval ; and � WHEREAS, the City has asked to delay final approval of the subdivision so that the final plat drawings may be amended to include utility .easements designating the proposed sewer lines; and WHEREAS, the applicant has asked Council to approve a building permit for Lot 4 prior to final subdivision approval . NOW, THEREFORE, BE IT RESOLVED, that the Ci�ty Council hereby approves the request of Edward T. Lehman to apply for a building permit prior to final subdivision approval subject to the following conditions : 1 . Prior to the issuance of a building permit, applicant must submit a survey designating the location and setbacks of the principal structure and driveway. 2. All construction shall be subject to the requirements of the State Building Code. • 3. A certificate of occupancy wiil not be.issued until the residence is connected to municipal sewer and the plat has received final subdivision approval . 4 . The applicant hereby agrees to assume full risk in applying for a building permit prior to resolution of the issue of sewering to adjacent propertiesand that the City issues this building permit with the knowledge that sewer is already available to Lot 4 through an existing sewer line. ir
