� Cit� o� OROl�O <br /> � � <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 150 7 . <br /> • ' <br /> ' A RESOLUTION VACATING AN <br /> � � � UNUSED PORTION OF CHARLES STREET <br /> WITHIN TflE PLAT OF ORONO ORCHARDS <br /> SECTION 2, TOWNSHIP 117, RANGE 23 <br /> IN TAE CITY- OF ORONO, MINNESOTA <br /> Whereas, the City of Orono is a municipal corporation organized and <br /> existing und'er the laws of the State of Minnesota; and <br /> Whereas , on May 20, 1983, Maurice W�gener and Charles Dettloff <br /> petitioned the City Council for vacation of an unused portion of Charles Street in <br /> the plat of Orono Orchards, Section 2, Township 117, Range 23 in the City of Orono , <br /> Minnesota except for that portion lying within the dedicated right of ways of <br /> Woodhill Road and Lyman Avenue (formerly Lane) ; and <br /> Trlhereas , the only affected adjoining property owner the Woodhill <br /> County Club has submitted a petition in favor of said vacation; and <br /> Whereas, after due published and posted notice, a public hearing was <br /> •held before the City Planning Commission on June 2�1 , 1983 , regarding said vaca.tion <br /> and all persons interested were given an opportunity to be heard; and _ . <br /> Whereas , after due study and consideration, the Planning Commissiori <br /> recommended approval of the requested vacation and the City Council of the City of <br /> Orono finds that it will be for the best public interest to approve such vaca�ion. <br /> Now, Therefore , Be It Resolved , that such Petition is hereby granted <br /> and that Charles Street as legally described above is hereby vacated pursuant to <br /> the following finding of fact : , . <br /> 1 . The vacation does not affect access to or use of any affected or <br /> adjoining property. <br /> 2. The City has not and does not intend to develop, improve or use the • <br /> property in any way. � <br /> 3. The property as it exists serves no public purpose . <br /> . <br /> This resolution was passed by a vote of 3 ayes and 0 nays on the <br /> 8th day of August, 1983. <br /> C • <br /> Mary C.
