CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 9 3 6 <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />a conditional use permit, a side yard variance, and hardcover variance in the 0-75' and 75-250' <br />lakeshore setback per Municipal Zoning Code Section 10.03, Subdivisi ~n 19 , Section 10.22, <br />Subdivision 2, Section 10.24, Subdivision 5 and Section i 0.09, Subdivision 5 to permit replacement <br />of a timber retaining wall with a concrete block wall in the 0-75' lakeshore setback and to remove <br />a timber walkway in the required north side yard and replace with a retaining wall, subject to the <br />following conditions: <br />1. The retaining wall and walkway will be constructed as shown in Exhibits C and E. <br />2. Authorities granted by this resolution run with the property not with the owners, but <br />are permissive only and must be exercised by application for a land alteration permit <br />within one year of the date of Council's approval , or the special conditions of this <br />resolution will expire on that date (July 28, 1998). <br />3. Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the Zoning Code , shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />4.
