Hardcover is proposed at 29% within the 75-250' setback area where <br /> 31.4% exists resulting in a hardcover decrease of 392 s.f. or 2.4%. <br /> D. Hardcover in the 0-75' setback area is proposed at 66 s.f, or 0.7% where <br /> 953 s.f. or 9.98% exists. <br /> E. 1,929 s.f. of a shared easement drive area has been deducted from the <br /> 75-250' setback area having additional impact on allowed hardcover. <br /> F. The City has received no negative comments from the property owners <br /> notified of this review. <br /> G. 9,550 s.f. of lakeshore yard consists of flat grassed yard area allowing <br /> for treatment of runoff before entering lake. . <br /> • 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit <br /> construction of a 12' x 24' two level single stall garage and grants a 4% hardcover variance <br /> within the 75-250' setback area, subject to the following conditions: <br /> Page 2 of 5 <br /> • . . <br />
