O O <br /> ti <br /> CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 9kESH0 NO. 3 8 1 8 N <br /> A. 46f% of the area of the this property is located within the 0-75' setback <br /> area where no improvements are allowed. <br /> B. The house is currently served by a single stall garage. <br /> C. All proposed improvements will meet the required setbacks of the LR-1 C <br /> Zoning Districts. <br /> D. There is no hardcover proposed within the 0-75' setback area. The <br /> lakeshore yard is a flat sloped grassed area. <br /> E. The proposed improvement plan as amended will be more consistent with <br /> the pattern of development within the Casco Cove neighborhood. <br /> F. The neighbors in attendance at the November 18th meeting of the <br /> Planning Commission noted their approval of the amended proposal. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district, that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property: %yould not merely <br /> serve as a convenience to the applicant, but is necessan, to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant: and would be in keeping vdth the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to 1VrunicipaI oning Code Section vision 14 (C)- <br /> Page 2 of 6 <br />
