approved by the city engineer. Instead, she went to the public <br />works director, John R. Gerhardson, who reviewed the site in person <br />and provided to Ms. Bellows a letter dated November 26, 1990 (a <br />copy of which is enclosed). <br />As you can see, it appears that the public works director <br />determined that additional filling or raising of the existing <br />driveway at Lot 2 would not be practical because of limitations and <br />space. This letter does not, however, constitute a resolution of <br />the city council of Orono which would allow for two separate <br />driveway accesses to County Road 146 for Lots 1 and 2 as <br />contemplated by both Ms. Bellows and John Morrison. <br />Would you please consider assisting Ms. Bellows in obtaining <br />another City of Orono resolution further amending Resolution #1985 <br />which eliminates the first three sentences of section 1, page 2, of <br />Resolution #2877? It would then be clear that the owner of Lot 1 <br />will be entitled to receive a separate driveway access to County <br />Road #146 so long as the owner of Lot 2 maintains all shrubs at <br />three feet height or less within an area located between the <br />traveled road and the utility pole, and the future owner and <br />developer of Lot 1 obtains an access permit from the Hennepin <br />Department of Transportation prior to application for a building <br />permit for new residential construction on Lot 1. Unfortunately, <br />I do not believe Ms. Bellows understands the legal necessity to <br />receive such a resolution in order to ensure that the owners of Lot <br />1 and Lot 2 will, in fact, be able to receive a separate driveway <br />access to each lot. It is my opinion that as things stand now, Ms. <br />Bellows has not complied with Resolution #2877 making it impossible <br />to get a permit for a separate driveway for Lot 1. <br />In addition, I would like to be kept advised as to any progress you <br />make in obtaining from the City of Orono an additional amendment to <br />Resolution #1985 clarifying this matter.
