Upon factual investigation of the Mortgage at Book 1795 <br />of Mortgages, page 187, Document No. 1662480, filed <br />October 26, 1931 (Entry No. 58) and the Quit Claim Deed <br />at Book 1753 of Deeds, page 288, Document No. 2454134, <br />filed August 5, 1947 (Entry No. 76) relating to property <br />adjoining the premises describea herein, it is our <br />opinion that these documents do not in fact create an <br />unmarketable title, however, we are obtaining quit <br />claim deeds from adjoining property owners to confirm <br />a marketable record title in Mr. Krogness. <br />5. Title is also subject to the followinq standard title <br />exceptions which should be reviewed carefully in regard <br />to the real estate described in the foregoing opinion: <br />a. Rights of Persons in Possession. It is not always <br />necessary for persons in actual possession of real <br />estate to file a record of their interest in the <br />property to retain such interest. A prospective <br />purchaser or mortgagee must inquire concerning the <br />rights, if any, of all parties in possession other <br />than the record owner. In addition, the property <br />should be inspected for any evidence of use or <br />possession by strangers or adjoining owners, such <br />as roads, driveways, drainage ditches and encroach- <br />ing buildings or fences. <br />b. Mechanics' Liens for Improvemenf_s. Persons furnishing <br />labor or materials for the improvement of real <br />property are allowed 90 days after the date the <br />last item of work or material is furnished within <br />which to file a lien statement. Accordingly, you <br />should inquire .- (_ whether there have been any <br />recent improvc—,ats upon the property or the <br />improvements thereto which remain unpaid. <br />C.
