In addition, the property <br />should be in.3pected for any evidence of use or <br />possession by strangers or adjoining owners, such <br />as roads, driveways, drainage ditches and encroaching <br />buildings or fences. <br />b. Mechanics' Liens for Improvements. Persons furnishing <br />labor or materials for the improvement of real property <br />are allowed 90 days after the date the last item of <br />work or material is furnished within which to file <br />a lien statement. Accordingly, you should inquire <br />as to whether there have been any recent improvements <br />upon the property or the improvements thereto which <br />remain unpaid. <br />C. Questions of Survey. The size and shape of the property, <br />the location of improvements thereon, and the presence <br />of encroaching structures upon or from adjoining <br />property, can be accurately ascertained only by a <br />survey of the property. <br />d. Security Interests in Fixtures or Crops. A security <br />interest may be held by a third party in recently <br />installed fi;;tures or in crops under Minnesotd Statute-, <br />Chapter 336. <br />e. Laws and Regulations. There are zoning, building, <br />subdivision, environmental, and other laws and regula- <br />tions affectiig the use, occupant' and transferability <br />of real estate. An adequate investigation of the <br />application of such laws and regulations should be made <br />with respect t,3 the intended use of the property. <br />f. Special Assessments. There may be levied or pending <br />special assessments for recent public improvements. <br />A check with th! municipality where the property is <br />located should •eveal whether there are any such <br />assessments. <br />g. Defects in Tit1E Known to You. If you have knowledge <br />of a mortgage, lain, or other defect in title or <br />interest in the property, you will take title subject <br />to such interest, even if no record of such interest <br />has been filed. <br />
