ft <br />. 1W. <br />Bruce Malkerson March 3, 1983 <br />For that reason, we have designed the following plan with your approval <br />and with the approval of the purchasers, Larry D. and Alvina R. Bader. <br />Mrs. Strong will close with Baders and convey fee title to the prop- <br />erty, transferring unplatted land, on March 4, 1983. We will file <br />the warranty deed immediately after closing. We wii then commence <br />an action to quiet title and extinguish the judgment liens based upon <br />Mrs. Strong's homestead exemption. We anticipate the action will go <br />by default since the issue of the homestead exemption has already been <br />raised in prior bankruptcy and prcblte proceedings without objection. <br />The Baderr will submit the following documents to the City Council so <br />that this matter can be considered at the Planning Commission's March <br />21st meeting: <br />1. Declaration of private Road Easement and Declaration of <br />Covenants for Maintenance of Same; <br />2. Road and Utilities Easement; <br />3. Quit Claim Flowage and Conservation Easement and Waiver <br />of Damages; <br />4. Mylars. <br />You indicated that the City would allow the Baders to submit the above <br />documents and make the appropriate appearances at the Planning <br />Commission and City Council for final approval of the subdivision. We <br />very much appreciate your cooperation and that of Ms. Maybusth in <br />facilitating this process so that the matter can be resolved on a <br />timely basis. Douglas Klint, attorney for the Baders, and the Baders, <br />have co;,curred in this plan and also extend their thanks to you, Ms. <br />Maybusth and the City cf Orono.
