EXHIBIT D <br />[DRAINFIELD COVENANT] <br />THIS INDENTURE,' is. made as of the day of , 19 <br />by {"Owners") <br />RECITALS: <br />WHEREAS, the Owners are the fee owners of the land legally described as <br />follows (the "Lot") : <br />Lot _ Block 1, CARRIAGE HILL, according to the recorded plat thereof, <br />Hennepin County, Minnesota. <br />WHEREAS, the City of Orono, Minnesota ("City") has required the Owners to <br />sign this Indenture acknowledging and creating, certain covenants against the Lot. <br />WHEREAS, the Lot has two sewage treatment sites that ' have been approved by <br />the City. The City has determined that these two sites are the only two feasible sites on <br />the Lot, and must not be disturbed. As such, the existing natural topsoil must remain in <br />place and must not be .subject to any traffic which will cause even the slightest <br />compaction. <br />NOW, THEREFORE, for good and valuable consideration, the receipt and <br />sufficiency of which is hereby acknowledged, the Owners do intend to subject their Lot <br />to the following covenants: <br />1. The Owners acknowledge and agree that the Lot has two sewage treatment <br />sites that have been approved by the City and the Owners understand that these two <br />sites are the only two feasible sites on the Lot, and must not be disturbed. <br />2. The Owners agree and covenant that the existing natural; topsoil on their Lot <br />shall remain in place and will not be subject to any traffic which will cause even the <br />slightest compaction. <br />3. The Owners agree that to protect those important sewage treatment sites from <br />inadvertent damage or destruction, they SHALL NOT permit any cars, trucks, or earth <br />moving equipment to enter upon their Lot or any the Lot of any other owner in the <br />Carriage Hill development. <br />
