0 0' <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 42, <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19-21 <br />FILE #2467 <br />WHEREAS, Steve Bohl, Bohland Development, (hereinafter "the applicant") has <br />an interest in the property located at 8xx Brown Road South within the City of Orono (hereinafter <br />"City") and legally described as follows: <br />Lot 1, Carriage Hill, Hennepin County, Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit to <br />allow for construction of a driveway to be located in King Street and shared with 775 Brown <br />Road South where grading is proposed within 5' of the property line per Section 10.03, <br />Subdivisions 19-21. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2467, a subdivision for property <br />located at 1025 Brown Road South known as "Carriage Hill." <br />2. The property is located in the RR-1B Rural Residential District. <br />3. The lot consists of 20.8 acres where 6.0 acres is dry buildable. <br />4. The proposed driveway is proposed to be shared with the adjacent northerly <br />property at 775 Brown Road South. No other residential lots shall be served by <br />the proposed driveway. <br />5.
