�e� -„ <br /> vN � .a <br /> 7 O� <br /> • O O <br /> �b. - CITY of ORONO <br /> � � � <br /> ti <br /> �� G'�' RESOLUTION OF THE CITY COUNCiL <br /> � ��kESHOg'� NO. � � � 5 <br /> A RESOLUTION ADOPTING THE <br /> ORONO ICE ARENA SANITARY SEWER AND WATER ASSESSMENT ROLL <br /> VVHEREAS, on February 24, 1997, the City Council adopted Resolution No. <br /> 3848 accepting the Orono Ice Arena sanitary sewer and water improvements feasibility <br /> report from the City Engineer and ordering the preparation of plans and specificaitons for <br /> the Orono Ice Arena sanitary sewer and water project; and <br /> WHEREAS, 100 % of the benefited property owners have petitioned for the <br /> sanitary sewer and water project and executed written waivers, waiving any rights to <br /> object to, or appeal from, this project or the assessment of the project costs, and have <br /> waived any rights to a public hearing on the feasibility of this project or the assessment of <br /> the project costs. <br /> • NOW, THEREFORE BE IT RESOLVED, by the City Council of Orono, <br /> Minnesota.: <br /> 1. Such proposed assessment, a copy of which is attached hereto and made a part <br /> hereof, is hereby accepted and shall constitute the special assessment against the lands <br /> named therein, and each tract of land therein included is hereby found to be benefited by <br /> the proposed improvement in the amount of the assessment levied against it. <br /> 2. Such assessment shall be payable in equal annual installments extending over a <br /> period of 15 years, the first of the installments to be payable on or before the first <br /> Monday in January 1998, and shall bear interest at the rate of 6.25% per annum from <br /> November 1, 1997. To the first installment shall be added interest on the entire <br /> assessment from November 1, 1997, until December 31, 1998. To each subsequent , <br /> installment when due shall be added interest for one year on all unpaid installments. <br /> 3. The owner of any property so assessed may, at any time prior to certification of the <br /> assessment to the County Auditor, pay the whole assessment on such property, with <br /> interest charged to the date of payment, to the City Treasurer, except that no interest shall <br /> be charged if the entire assessment_is paid within thirty (30) days of October 29, 1997; • <br /> � and he may, at any time thereafter, pay to the City Treasurer the entire amount of the <br /> assessment remaining unpaid, with interest accrued to December 31 of the year in which <br /> such payment is made. Such payment must be made before November 30 in 1997, or <br /> • before November 15 in a subsequent year or interest will be charged through December <br /> 31 of the next succeeding year. � <br />
