CITY OF ORONO RESOLUTION OF THE CITY COUNCIL t PL, NO. 7678 k£S H A RESOLUTION GRANTING AN EXTENSION TO RPUD MASTER DEVELOPMENT PLAN APPROVAL FOR ORONO APARTMENTS PLANNED UNIT DEVELOPMENT NO. 17 (LA20-000001) FILE NO. LA26-000011 WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") adopted land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Orono Apartments LLC is the owner(hereinafter the"Owner")of the property at 2745 Kelley Parkway, legally described at Lot 1, Block 2, City of Orono Addition (hereinafter the "Property"); and WHEREAS, the City Council granted a Master Development Plan approval, LA20-000001, for the proposed 56 unit apartment building via Resolution 7085, which had an original expiration date of April 13, 2021; and WHEREAS, City Staff granted a one year extension until April 13, 2022; and WHEREAS, on January 7, 2022, the City Council granted the Owner's second request for an extension to April 13, 2023; and WHEREAS, on March 21, 2023, the City Council granted the Owner's third request for an extension to April 13, 2024; and WHEREAS, on March 11, 2024, due to issues related to supply chain of material and financing,the Owner request a fourth Master Development Plan approval extension to April 13,2025. WHEREAS, on March 10, 2025, the City Council granted the Owner's fifth request for an extension to April 13, 2026; and WHEREAS, on April 13, 2025, the City Council granted the Owner's 6th request for an extension to April 13, 2027; and NOW,THEREFORE, BE IT RESOLVED the City Council of the City of Orono does hereby grant a 6th extension for Master Development Plan Approval for PUD No. 17, to expire April 13, 2027 unless a building permit has been obtained. 1
