B. <br />C. <br />D. <br />E. <br />CITY of IDR()NO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3921 .4 <br />The zoning lot is an irregular shape. <br />The topography of the lot is steep at the rear and side yard. <br />There are utility poles and easements on the zoning lot where new <br />construction cannot occur. <br />Septic sites on the zoning lot must be protected. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not mE -ely <br />serve as a convenience to the applicants, but is necessary to allevia a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the e'1;"-,wing above fit. ;s, the Orono City Council <br />hereby grants a rear yard variance to add a uiird stall to the garage and a 5' addition to an <br />existing porch to reduce the r-lar yard to 35' and 38' where 50' is required per Municipal <br />Zoning Code Section 10.28, Su,,C1,ision 5, subject to the following conditions: <br />1.
