NO. 3 9 6 5 <br /> � S <br /> � A RESOLUTION APPROVING THE <br /> PLAT OF FULLERTON ESTATES <br /> FILE NO. 2204 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and � <br /> WHEREAS, the City Council of the City of Orono has adopted subdivision <br /> regulations for the orderly, economic and safe development of land within the City; and <br /> WHEREAS, the City_Council has considered this application for a Class III <br /> subdivision of a five lot plat by James G. Fullerton, III (hereinafter "the subdivider"); and <br /> WHEREAS, per Resolution No. 3879 of the City of Orono, the City Council <br /> approved the preliminary plat application for the five lot residential subdivision on Apri124, 1997; <br /> . �and <br /> WHEREAS, the subdivision has been found to meet all standards of the LR-lA, <br /> Lakeshore Residential Zoning District, finding that each lot is of a size and configuration that <br /> would allow its use as a single family residence to be fully developed without the need of any <br /> variances; and <br /> r <br /> WHEREAS, the subdivider has completed all requirements of the platting <br /> � regulations of the City, including: <br /> 1. Completion of all the requirements of Resolution No. 3879, the resolution of the <br /> City granting preliminary approval of the plat. <br /> 2. Creation of a stormwater facility maintenance agreement, drainage easements for <br /> Lots 1 and 2, and Declazation of Building Restrictions for Lot 3. . <br /> 3. Executed a Developer's Agreement and posted a Letter of Credit written to 150% <br /> of the cost of required improvements. Required improvements shall include all <br /> grading/drainage improvements and road improvements as shown on plans and <br /> specs by Mark S. Gronberg, a registered professional engineer, Job #96-266, sheet <br /> 1 of 1, dated 6-20-97 and revised 9-5-97. <br /> • � <br /> Page 1 of 2 <br />
