N O. � :� 4 �, �1 <br /> S <br /> A RESOLUTION APPROVING <br /> THE VACATION OF <br /> A PORTION OF DEDICATED ROAD RIGHT-OF-WAY AND PARK <br /> � WITHIN THE PLAT OF SAGA HILL REVISED � <br /> -FILE NO.2277 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, W. Wyatt and Nancy Moe (hereinafter the "applicants") on July 25, <br /> 1997,filed a formal application with the City of Orono (hereinafter"City")for vacation of a portion <br /> of the right-of-way and a portion of park dedicated within the plat of Saga Hill Revised, Hennepin <br /> County, Minnesota, such portions to be vacated being legally described as follows: <br /> Exhibit A, attached (hereinafter "the property"); and <br /> • WHEREAS, after due published and mailed notice, the Orono Planning <br /> Commission held a public hearing on August 18, 1997 regarding said vacation, at which time <br /> all persons desiring to be heard concerning this application were given the opporhuiity to speak <br /> thereon; and <br /> WHERE�iS, after due standing and consideration, the Planning Commission <br /> recommended approval of the requested vacation and the City Council of the City of Orono <br /> fmds that said vacation, as proposed, is in keeping with the public interest in consideration of . <br /> the following findings: ' <br /> . 1. ` The vacation does not affect access to or use of any adjoining properry. <br /> 2. The City has not and does not intend to develop, improve or use the described <br /> portions of dedicated right-of-way or paxk for road or park purposes except for <br /> utilities, access and drainage purposes hereinafter described. <br /> 3. The unimproved described portions of dedicated right-of-way and park as they <br /> exist serve no public purpose. <br /> • � Page 1 of 3 <br />
