`• .or- 4718416 <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1331 <br />A RESOLUTION APPROVING THE PLAT OF <br />DICKEY LAKE ADDITION <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existit;g under the laws of the State of Minnesota; and <br />WHEREAS, the City Council. of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development <br />of land within the City; and <br />WHEREAS, the City council has considered the application for <br />a subdivision plat by Charles E. Van Eeckhout and Sue L. Van Eeckhout, <br />the subdividers; and <br />WHEREAS, the subdivision has been approved as meeting all <br />standards of the RR-1B zoning district finding that each lot is of a <br />size and configuration that will allow its use as a single family <br />residence to be located without the need of any setback variances; and <br />WHEREAS, the subdividers have completed all requirements of <br />the platting regulations of the Ci,:y, including: <br />1) Dedication on the plat of drainage and utility easements. <br />2) Dedication on the plat of right of way for a public <br />road, shown as Brown Road North. <br />3) Creation of a new private road shown on the plat as <br />Outlot A, to be known henceforth as Salem Court. <br />4) Concurrent with the creation of this private road, the <br />:;ubdivider has dedicated to the City a Road and Utilities <br />Easement granting to the City permanent access, improvement <br />and utility easements over said Outlot; the Subdivider <br />has created nor. -exclusive ingress, egress, drainage <br />and utility easements over said Outlot in favor of all <br />abutting and/or benefiting lots including a declaration <br />of certain maintenance covenants wherein each of the <br />abutting and/car benefiting lot owners covenants and agrees <br />to permanently maintain and pay the cost of maintenance <br />for said private road. <br />5) Dedication to the City of a Flowage and Conservation <br />Easement providing for limitations on the use of <br />wetlands and/or drainageways described thervin and <br />shown on t_he Eclat as "drainage easements". <br />1 of, 2 <br />
