MINUTES OF A PLANNING COMMISSION M'' 'NG HELD ON AUGUST 14, 1978 <br />Page 3 <br />Mr. Gardner was present. Olson stated that all <br />requirements have been met and the staff now <br />recommends approval. <br />NOTE: Wilson raised some legal concerns regarding <br />the format of our resolutions for plat approval <br />and wondered if staff should investigate a more <br />efficient method to ensure proper r-cording of <br />required documents. Olson stated this was an <br />interim problem and what the City attorney intends <br />to do in the adoption of the ordinance is to have <br />the City, in the presence of the applicant, do <br />the recording. <br />KARL GARDNER <br />2885 Sixth Ave. <br />FINAL PLAT <br />(#356) <br />No. <br />Hassel moved to approve the final plat in accordance <br />with the attached resolution. Motion seconded by <br />Wilson. Vote: Ayes (4), Nays (0). Motion <br />passed unanimously. �/ <br />Mr. Kelley was present. Olson stated that the ✓i�LOYD S. KELLEY <br />preliminary plat has been returned in the final 85 South Brown Road <br />form and all technical requirements have been met. FINAL PLAT <br />(#372) <br />Hurr recommended approval of the final plat in <br />accordance with the attached resolution. Motion <br />seconded by McDonald. Vote: Ayes (4), Nays (0), <br />motion passed unanimously. <br />Mr. Plank was present. The preliminary plat was MICHAEL PLANK <br />approved at the last Planning Commission meeting. 4145 Watertown Road <br />The location of the septic system was discussed VARIANCE <br />in great lengths. Planning Commission was very (#399) <br />concerned with having to issue a setback variance <br />on a 5-acre lot particularly when the lot is newly <br />subdivided. After a couple of unsuccessful motions <br />and considerable discussion regarding the physical <br />problems and alternative solutions, Hassel moved <br />to approve the variance in that the hardship appears <br />to be contour and configuration of the land and <br />wetlands and the designated site for the septic system. <br />It was felt that because of slope of the ground and low <br />areas on the lot, there would be drain:tge problems, <br />access problems (driveway grade) and passible drainfield <br />operation problems if the house was moved 25 ft. further <br />from the road which would justify this variance. Motion <br />was seconded by Wilson. Vote: Ayes (4), Nays (0). <br />Motion passed unanimously. <br />
