utilities, pathways, ·1andscaping, and any other improvements <br />hereinafter described on the terms and conditions hereinafter <br />set forth. <br />NOW, THEREFORE, in consideration of the premises and of <br />the mutual promises and conditions hereinafter contained, it <br />is hereby agreed as follows: <br />1. A. Warranty of Subdivider. The Subdivider hereby <br />warrants and represents to the City as inducement to the City's <br />entering into this agreement, that Subdivider's interest in <br />the Subdivision is as set forth on Exhibit B attached hereto. <br />(Indicate whether fee owner, vendee under contract for deed <br />from named vendor, or other vested interest. Prior to Final <br />Plat Approval and execution of agreement, a title opinion must <br />be provided to the City and all persons with any interest in <br />the subdivision must execute this agreement; contract for deed <br />vendors, mortgagees and others with a claim of title or who <br />hold equitable title must agree to allow the Subdivision to <br />be encumbered by the terms of this agreement.) <br />1. B. Covenants Concerning Title.
