City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2048 <br />A RESOL~~ION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE 01071 <br />EM <br />WHEREAS, Colin Kelly and Lona Jane Shaughnessy <br />(he reinafter "the applicants") are the owners of the property <br />lo~ated at 95 Brown Road South within the City of Orono <br />(hereinafter 11 City") and legally described as follows: <br />Lot 2, Block 1, Kelley Green, Hennepin County, Minnesota <br />(hereinafter "the property"): and <br />WHEREAS, the applicants have applied to the City for a <br />variance to Municipal Zoning Code Section 10.28, Subdivision 5 <br />(B) to permit the construction'., of a single family residence to be <br />located 37.3 feet from the front lot line and 33.9 feet from the <br />rear lot 1 ine where front and rear yard setbacks of 50 feet are <br />normally required. <br />NOW, THEREFORE, BB IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1071. <br />2. The property is located in the RR-1B Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 15, 1986, and recommended approval of the <br />proposed variances based upon the following findings: <br />A) The narrowness of this recently created lot is a <br />hardship in that it leaves little flexibility in <br />locating the house to fit the landscape. Under code <br />requirements the allowable building envelope without <br />variances is only 44' deep. <br />Page 1 of 4
