§ 6.06 <br />SEC. 6.06. CONSTRUCTION AND RECONSTRUCTION OF PRIVATE ROADWAY <br />SURFACING, SIDEWALK, CURB AND GU~~'ER, DRIVEWAY APPROACHES OR CURB <br />CUTS. <br />Subd. 1. Methods of Procedure. Abutting or affected <br />property owners may contract for, construct or reconstruct private <br />roadway surfacing, sidewalk or curb and gutter, driveway, driveway <br />turnaround, driveway approaches or curb cuts in accordance with <br />this Section. <br />Subd. 2. Requirement and Application for Permit. It is <br />a misdemeanor to construct or reconstruct a sidewalk, curb and <br />gutter, driveway~ driveway approach, driveway turnaround, curb <br />cuts, roadway surfacing or any other private improvement in any <br />private road or private property in the City without a permit in <br />writing from the City. Application for such permit shall be made <br />on forms approved and provided by the City and shall sufficiently <br />describe the contemplated improvements, the contemplated date of <br />beginning of work, and the length of time required to complete the <br />same, provided that no permit shall be required for any such <br />improvement ordered installed by the Council. Such application <br />shal 1 also contain information showing the type of construction, <br />the width and the location of an improvement on the parcel of land <br />and the lot and block number or the parcel number and the street <br />and house number and a profile of the proposed improvement, if <br />necessary, and other such information as may.be required by the <br />Public Works Director. The application shall be filed by the <br />property owners desiring to construct such a driveway approach, <br />sidewalk, curb and gutter, driveway, driveway turnaround, curb cut, <br />roadway surfacing or private improvements in any private road or <br />any property in the City, or by his or her duly authorized agent. <br />All such applications shall contain an agreement by the applicant <br />by this Chapter. A permit from the City shall not relieve the <br />holder from damages to the person or property of another caused by <br />such work. These regulations shall apply to all City, State, <br />County and private roads. <br />Subd. 3. Issuance of Permit. Such permit shall be <br />issued by the Public Works Director, if he or she has determined <br />that the applicant has complied with the terms of this ordinance, <br />the permit fee hereinafter specified has been paid and the Public <br />Works Director has approved the driveway, driveway approach, <br />driveway turnaround, sidewalk, curb and gutter, curb cuts, roadway <br />surfacing or private improvement in any private road or other <br />private property in the City as requested or with stipulated <br />changes. The Public Works Director shall have the authority to <br />refuse to issue a permit when, in the judgement of the Public Works <br />Director, the requested construction would impose an unreasonable <br />hazard to the public. Such decision may be appealed in writing by <br />the applicant to the City Council. The City Council shall have the <br />power to affirm, reverse or modify the decision of the Public Works <br />Director. <br />ORONO CC 142 (7-25-88)
