§ 6.05 <br />Subd. 5. Revocation of Pennit. <br />A. All permits granted for the use of public <br />property under the terms of this Ordinance shal 1 be revocable by <br />the Public Works Director pursuant to the procedure set out below <br />in Section 6.05, Subd. 6, "Authority of Public Works Director." <br />B. In addition to the provisions of Section 6.05, <br />Subd. 6, a permit may be revoked by the City Counci 1 and City sha 11 <br />have the right to revise, relocate or close any sidewalk, curb and <br />gutter, driveway, driveway approach, driveway turnaround, curb cut <br />or private improvement in any public road or other public property <br />in the City as the result of the reconstruction of any road, a <br />change in land use, or a major change in the traffic pattern of an <br />existing land use. <br />Subd. 6. Authority of Public Works Director. <br />A. Al 1 work done under a permit issued in <br />compliance with this Ordinance shall be under the direction and <br />supervision of the Public Works Director, who is hereby authorized <br />to make the necessary rules, regulations and specifications with <br />respect to materials for and method of construction of a sidewalk, <br />curb and gutter, driveway, driveway approach, driveway turnaround, <br />curb cut, roadway surfacing or private improvement in any public <br />road or other public property in the City. A·copy of such rules <br />and regulations shall be kept on file with the City Clerk. A <br />pennit issued under the provisions of this Ordinance may be revoked <br />by the Public Works Director when he or she determines that the <br />construction or activity authorized by the permit is not being <br />perfonned according to the tenns of the pennit of this Ordinance. <br />B. Notice of such revocation, with a description of <br />the facts supporting such revocation, shall be mailed or delivered <br />to the person named in the permit at the address listed in the <br />pennit. <br />C. All work shall cease upon receipt of the Notice <br />of Revocation. <br />D. Any person whose permit is revoked as set forth <br />herein may appeal that revocation to the City Council by filing <br />notice of such appea 1 with the City C 1 erk within ten ( 10) days of <br />the date that the revocation was mailed or delivered. <br />E. The appeal of such revocation shall be conducted <br />according to the procedure set forth in Section 6.05, Subd. 3, <br />"Issuance of Penni t" herein. <br />ORONO CC 141 (7-25-88)
