easement would be required should it become necessary for the City to acquire the road and open <br />it as a public road. <br />8. A Homeowner's Association shall be created for the maintenance of the private road and drainage <br />structures within the development. The owner of the 130 Brown Road property, southwest of the <br />development and south ofTract G, has access from the private drivewaywithin Tract G and shall <br />become part owner of a private road. <br />Sketch Plan <br />The City Council and Planning Commission have reviewed the proposal as part of the Sketch Plan review <br />process. Please note the attached Minutes (Exhibits J and K). <br />The City Council recommended to the property owner the City of Orono has no intent to rezone the <br />property from the two acre standard. The Council has indicated they would consider developing the site <br />as a PRD and make a provision for sewer service. <br />Conformity to Zoning District Standards and Comprehensive Plan <br />The RR-lB zoning district allows a property to develop as a PRD as a conditional use. Under the PRD <br />the City can establish setbacks for each of the lots. The dry buildable areas oflots 1, 2, 3 and 4 are limited <br />and are between 1/2 acre to 1 acre dry buildable. The lots also are similar to the lots located north of the <br />development in the City of Long Lake. The proposed setbacks shown on the site plan indicate a 3 5' front <br />yard setback, 1 O' side yard setback and a 30' rear setback. The established setbacks are similar to other <br />lots in Orono that are zoned 1/2 acre to 1 acre in size. <br />Lots 5, 6 and 7 are located south of the proposed private road and be subject to setback standards for <br />the RR-lB zoning district. They would be developed with an average size close to two acres. They would <br />be a transition between the higher density to the north and the RR-lB two acre south of the Luce Line Trail. <br />All lots appear to provide suitable building sites based on sewer service being available to the property. <br />Lot 7 is very wide and has very little lot depth. The property is bounded to the north by Long Lake Creek <br />and the South by the Luce Line Trail. The rear yard setback is along the Trail. The front yard setback is <br />5 O', but Long Lake Creek is defined as a tributary stream and is within the shore land protection area. A <br />75' setback for structure and hardcover is required the same as they apply to lakeshore areas. More <br />detailed grading plans are required.
