A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-420, SUBDIVISION B <br />FILE NO. 03-2965 <br />WHEREAS, Franz A Jevne VI and Kersten N Jevne, husband and wife <br />(hereinafter "the applicants") are the owners of the property located at 819 Brown Road <br />North within the City of Orono (hereinafter the "City") and legally described as follows: <br />The North 150 feet of the South 354.75 feet of the East 323.4 feet of the <br />Southwest Quarter except the road, Hennepin County, Minnesota <br />(hereinafter the "property"); and <br />WHEREAS, the applicant has made application to the City of Orono for <br />variances to Orono Municipal Zoning Code Section 78-420, Subdivision B for lot width <br />and lot area variances and to allow a side yard setback of 24' when 30' is required, for <br />construction of a new residence upon the existing foundation. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #03-2965. <br />2. The property is located in the RR-lB, Single Family Rural Residential <br />Zoning District, which requires a minimum lot area of 2.0 acres and a <br />minimum lot width of 200'. The property contains 43,819 s.f. (1.0 acre) <br />and a lot width of 150.03'. <br />3. The Planning Commission reviewed this application at a public hearing <br />held on January 20, 2004 and recommended approval of the variances <br />based on the following findings: <br />a. No additional land is available for acquisition by the applicants to <br />make the prope1iy conforming in area or width. <br />Page 1 of 5
