The only feasible site for replacement of the existing system is 97' from <br /> � the Ordinary High Water mark of French Lake. <br /> C. Zoning Code Section 10.56, Subdivision 16 (C) requires that any septic <br /> system be located at least 150' from a Natural Environment Lake. The <br /> � property was developed prior to adoption of the 150' setback, and the <br /> configuration and layout of existing improvements on the property make <br /> . it impossible to locate a septic system at a confornung location on the <br /> property. � <br /> D. The proposed system has been designed to meet all the pertinent State . <br /> standards. <br /> E. Granting of the proposed variance will have no impact on neighboring <br /> • " � properties and will have a positive impact on the quality of French Lake <br /> by allowing the replacement of non-conforming septic system with one <br /> that is expected to provide adequate sewage treatment in all anticipated <br /> ground water conditions. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and � <br /> welfare of the community. <br /> 5. The City Council fmds that the conditions existing on this property are peculiar � <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> � . � . pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> ' intent of the Zoning Code and Comprehensive Plan of the City. � <br /> • . .
