L`9kESH�4� N0. :� � O � <br /> NOW, THEItEFORE, BE IT RESOLVED by the City Council of Orono, . <br /> Minnesota: � <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #2234. ' <br /> 2. The property is located in the LR-1B, One Family Lakeshore Residential Zoning <br /> District where the minimum lot area requirement is 1 acre. <br /> 3. The Orono Planning Commission reviewed this application on May 19, 1997, <br /> . and recommended unaniinous approval of the proposed variances based upon the <br /> following unique findings and hardships: <br /> • A. The lot does not meet the minimum lot area and lot size requirements for <br /> the LR-1B Zoning District. <br /> B. The cunent residence and garage do not conform to the setback <br /> requirements from the side or street property lines. <br /> � C. The current driveway requires an easement over adjacent property. <br /> D. The existing garage is located in the road right-of-way. <br /> 4. The City Council fmds tliat the conditions existing on this properly are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor � <br /> pose a fire hazard or other danger to neighboring properly; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> deinonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> , recoinmendations of the Planning Commission, reports by City staff, coirunents <br /> ' • Page 2 of 4 . <br />
