The garage is proposed to access using the existing driveway and is proposed to be <br />located between the principal structure and the street (Brown Road). The proposed detached garage <br />meets the rest of the required setbacks ; however the plumbing requires a conditional use permit. <br />Prior to the issuance of a building permit, the applicant may be subject to the buffer, covenant and <br />easement requirement Orono's Wetlands Protection Ordinance . John Smyth has not reviewed the <br />wetland information as it is not immediately relevant to the variance and conditional use permit as <br />requested. <br />Planning Commission Recommendation <br />On October 15, 2007, Planning Commission voted 5-0 to recommend approval of the variance and <br />conditional use permit on the consent agenda consistent with the staff recommendation. <br />Planning Staff Recommendation <br />Staff recommends approval of the variance and conditional use permit per the attached Resolution. <br />COUNCIL ACTION REQUESTED <br />Adopt or amend the attached Resolution .
