A RESOLUTION <br />GRANTING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-420 <br />FILE NO. 13-3619 <br />Council <br />Exhibit A <br />WHEREAS, Paul Warner and Jessica Warner, a married couple (hereinafter <br />"the Applicants") are the owners of the property locat~d :at 1380 Briar Street within the City of <br />Orono (hereinafter the "City") and legally described as: The West .Half of Lots 3 and 4, Block <br />2, MARKVILLE (hereinafter the "Property"); and <br />WHEREAS, the Applicants have. made application to the City of Orono for a <br />variance from Orono Municipal Zoning Code Section 78-420 to allow construction of additions to <br />the existing home 25 feet from the front property line where a 50 foot setback is required; 19 <br />feet from the rear property line where a 50 foot setbacfis required; and 14.4 feet from the south <br />side lot line where a 30 foot setback is required; and · <br />WHEREAS, after due published notice Eind mailed notice in accordance <br />with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br />Orono Planning Commission on August 19, 2013 at which times all persons desiring to be heard <br />concerning this application were .given the opportunity to speak .thereon. <br />' ' '; <br />Minnesota: <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />"t.. This applic;3tion was ~eviewed as Zoning File number 13-3619. <br />2. The Property is.located in the RR-1B One Family Rural Residential Zoning <br />D.i.strict which req~jres a minimum lot area of 2.0 acres and a minimum lot width <br />of 200'. <br />3. The Planning Commission reviewed this application at a public hearing held on <br />August 19, · 201:3 and voted 6 for and O against on a motion to approve the <br />setback variances. The Planning Commission finds that the following factors <br />support the granting of the requested variances: <br />a. The Property contains 14,000 square feet in area and has a defined width of <br />160-feet. The Property is 160 feet wide on Briar and 87.5 feet deep. It does <br />not conform to the 2 acre minimum lot size of the RR-1 B district. <br />Page 1 of 4
