Mabusth Zoning <br />Title Building & Zoning Administrator <br />Item Description: #2042 Thomas Frank, 1233 Briar Street -Variances -Resolution <br />Zoning District: RR-lB <br />Total lot area = 2+ acres <br />Total dry buildable area = 39,400 s.f. <br />Property is sewered. <br />Additional Exhibits <br />J -DNR Letter of 8/21/95 received after 4:30 p.m. <br />Description of Application <br />Applicant proposes the replacement of an existing deck 5'x15' with a new expanded deck at <br />approximately 12'xl 7', refer to Exhibit I. The new deck will encroach approximately 3' beyond <br />the average lakeshore setback line (refer to Exhibit G). The topography and distance between <br />the two residences will minimize any impact created with the expansion of the deck. The deck <br />will not be seen from the view windows of each residence. The existing deck is approximately <br />137' from the shoreline of French Lake. Applicant proposes the new deck at 131'. Both the <br />existing deck and proposed deck will be located within the required 150' structural setback from <br />the natural environment lake. <br />Review Exhibit J, the DNR representative asks that structure not extend any closer to the lake <br />than the existing deck setback at 137' and that applicant provide natural screening to protect <br />views from French Lake. Planning Commission felt the DNR representative should visit the site <br />as there is an extensive yard with existing natural screening. The house is located to the extreme <br />southeast corner of property and not within direct view of shoreline of French Lake. 310 s.f. <br />deck will be placed over 95 s.f. of existing landscape and paved areas. A corner of the <br />proposed deck will extend 131' from the shoreline. The remainder of the deck will be behind <br />the 131' setback. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the application as proposed. <br />The enclosed approval resolution has been drafted per the findings and conditions of the <br />Planning Commission recommendation. <br />COUNCIL ACTION REQUESTED: <br />To deny, approve or amend the enclosed approval resolution. <br />ch
