Mabusth Zoning <br />Title Building & Zoning Administrator <br />Item Description: #2048 James and Joann Jundt, 1400 Bracketts Point Road -Conditional Use <br />Permit -Resolution <br />Zoning District: LR-lA <br />Total lot area = 13 + acres <br />Pertinent Ordinance <br />Section 10.28, Subd. 3 (A) -Conditional use permit for studio apartment within oversized <br />accessory structure that already contains a three bedroom two level caretaker unit, a two <br />bedroom guest house. <br />Brief Review of Application <br />Applicants have applied for a conditional use permit for a third residential unit within the <br />oversized accessory structure, refer to Exhibits C and E. The original conditional use permits <br />:or the caretaker and guest house units were conditioned on an approved septic system being <br />installed within the construction year of 1995. Since those approvals, the Bracketts Point <br />neighborhood is in the process of petitioning for sewer and the area included within the current <br />Comp Plan I .mendment that proposes a realignment of the MUSA line within the City. Sewer <br />would not be available until 1996. It is not reaso;nable to expect the applicants to install the <br />septic system now that the City is considering the extension of sewer to the Bracketts Point <br />properties. <br />The Planning Commission was asked to consider a deadline date for the installation of a <br />conforming septic system should be the Comprehensive Plan process fail in 1995/96 season. <br />Septic systems that currently serve principal structure and the oversized accessory structure have <br />shown no visible signs of failures. Inspections conducted by the on-site system manager in 1994 <br />confirmed that the existing systems were non-conforming and did not meet the required 3' <br />separation. The applicants have willingly agreed to install conforming septic systems as soon <br />as the extension of sewer to the area is resolved by both the City and the MET Council.
