That the description set forth in the decree herein includes <br />a portion of Center :.venue as platted as it appears in Book 12 of Plate <br />on Page 5-1/2 which has not been formally vacated, but Eduard J. O'Brien, <br />now deceased, the present oviner of record, is the owner of said portion <br />of said avenue by virtue of his ownership of the adjoining; premires and <br />by reason of the abandonment of sane more than %thirty years ago, and the <br />substitution of another road -,,ray in its place in the rear o: the premises <br />involved herein which has been in co::.ron use for longer than thirty years; <br />and any public easement of said portion of Center Avenue included in the <br />description herein has been discharged by alandin.:.ent and substitution <br />as above; <br />That the description contained in the original report of the <br />examiner had been changed so that it includes orly that part of said <br />Center Avenue which has been abandoned. <br />NOW.
