A) Applicant shall provide the City Engineer with a <br />detailed final grading and retaining wall plan, which must <br />be approved before permits can be issued for the <br />grading/retaining wall construction. The City Ergineer <br />shall work in conjunction with the applicants to establish <br />suitable limits for the grading work. <br />B) The applicants shall maintain existing <br />vegetation on the lakeshore Lanx as proposed, and shall <br />plant additional vegetation to screen the proposed 241-300 <br />high retaining wall from the lake to reduce its visual <br />impact. Applicant shall use native materials and natural <br />coloring to minimize the visual impact of this wall to the <br />greatest extent possible. <br />C) As proposed, the applicants shall construct a <br />drain tile system between the existing residence and the <br />lakeshore, to redirect the drainage from the 0-75' zone to <br />the 75-250' zone for dispersal. <br />D) As proposed, the applicants shall remove the <br />sq. ft. of pavers near the lake. <br />18. Authorities granted by this resolution run with the <br />)roperty not with the applicants, but are permissive only and <br />must be exercised by application for a building permit within one <br />year of the date of Council approval, or the special conditions <br />of this resolution will expire on that date (January 1991). <br />19. Violation of or non-compliance with any of the terms <br />and conditicns of this resolution shall constitute a violation of <br />the zoning code, shall automatically terminate any authority <br />granted herein, and shr11 be punishable as a misdemeanor. <br />20. The undersigned ap,licants have read, understood and <br />hereby --tree to the terms of this resolution and on behalf of <br />themse .s, their heirs, representatives and assigns, hereby <br />agree to the recording of this resolution in the chain of title <br />of the property. <br />Adopted by the Orono City Council on this day of <br />January, 1990. <br />ATTEST: <br />Dorothy M.
