The applicants have been asked to file a conditional use <br />permit to allow the major renovation of the existing caretaker unit on the second floor of the <br />main house. A building permit has been issued to allow commencement of the work, but <br />kitchen area will not be installed until conditional use permit is completed. Refer to Section <br />10.20, Subd. 3 (G) (2) to review necessary standards for non-rental apartment use. Review <br />Exhibit H. Access to the apartment is via a hallway that connects to the main house with a <br />secondary access from a staircase from the garage below. The apartment shall be for the <br />exclusive use of the domestic employees of owner. The caretaker apartment has never been <br />assigned a separate address by the City. <br />Review Weckman's memo, Exhibit E. Council adopted an interim ordinance that will <br />delay the enforcement of the new Septic Ordinance and Shoreland Regulations as they relate to <br />septic systems that do not meet the required 3' separation from the bottom of the trench to the <br />seasonal water table. Brackett's Point has been classified as a "hot spot" which means that this <br />area may be considered by Council for sewer. Such areas may be given special consideration <br />but at this· time nothing has been decided by the Council. During the 13-year septic inspection <br />program, the system has never been found to be surfacing. <br />Staff recommends approval of Application #1866 granting a conditional use permit for <br />the continued use of the caretaker apartment subject to the condition that the apartment may <br />never be used for rental use. <br />Application #1867 -Variances to Shoreland Ordinance and Hardcover Regulations to Allow <br />Third Access Stair and Deck at Shoreline <br />Refer to Exhibits I and J.
