'The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this Zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the Cityo <br />recommendations of the Planning ornmission, reports by ity staff, commoo <br />by the applicant and the effect of the proposed variance on the healtho safety4 =4 <br />welfare of the community. <br />COt�ICLUSIONS, ORDER AlVli CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Cotrritf <br />hereby grants variances to Municipal Zoning Code Section .10.22, Subdivisions I (B) <br />permit the repair of two existing stone access paths located in the lakeshore protected area whom <br />excesses of hardcover exist and where no expansions are proposed, subject to the following <br />condition: <br />1. Applicants shall obtain a building permit for the renovation of stone step <br />structures. <br />2. Appropriate erosion control shall be maintained during the period of time <br />groundcaver remains in a disturbed state. <br />3. The boathouse and grotto structure located wY,hin the 045' setback area are <br />considered non-confoiuiing and subject to all pertinent sections of the code that <br />govern non -conforming structures.
