Structure does not meet the required side yard setback but the y�ature of <br />the structure and the uniqueness of this property would suggest that even <br />if subdivided in the future, it is unlikely that this structure would remain <br />as a principal structure. <br />c. The subject structure has existed for over fifty years. <br />4, The City Council fi�xls that granting a conditional use permit to allow the <br />continued use. of the guest house will not be detrimental to the health, safety or <br />general welfare of the public, would not adversely affect light, air nor pose a fire <br />hazard or other dark 7 to neighboring properties, nor will its use depreciate <br />surrounding property values and that the proposed level of use of the property <br />will be in keeping. with the intent and objectives of the Zoning Code and - <br />Comprehensive Plan of the City. <br />5. The CitJ Council finds that the conditions existing on this property are peeuligr- <br />to it and do not apply generally to other property in this zoning. district; that` <br />granting the. variance would not adversely affect traffic conditions, light, air nor - <br />pose a fim hazard or other danger to neighboring property; would not merely <br />served as a. convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to pmserve a substantial property <br />right. of the applicant; and would _be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />fi.
