The subject property is located adj�acent to a wetland and provides maintenance vehicle and walking access to the Luce Line Trail. B. The City of Orono uses this area for snow storage. C. The proposed berxn will not interfere with sight lines for vehicular traffic or future septic systems. 5. The City Council finds that granting a conditional use permit will not be ' detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the . proposed level of use of the property will be in keeping with the intent and • � � objectives of tlie Zoning Code and Comprehensive Plan of the City. � . . 6. The City Council has considered this application including the findings and recommendations of the Planning Cominission, reports by City staff, comments by the applicant and the effect of the proposed conditional use permit on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivisions 19-21 and Section 10.55, Subdivisions 8-14 to permit raising the parking lot by adding 23,200 cubic yards of fill. Approval was subject to the following conditions: � �- � 1. A silt fence will be installed to protect the wetland. The wetland edge shall be delineated and a 26' buffer shall be maintained. 2. The fill height at the southern end shall be 4' below the road and will increase to 6' above the road at the northern end. • Page 2 of 5
