RESOLUTION OF THE CITY COUNCIL <br /> � � �9kESH04��' � NO. � � �`� . . � <br /> A RESOLUTION GRANTING PRELIMYNARY , <br /> APPROVAL OF A CLASS III SUBDIVISION <br /> FOR PROPERTY LOCATED AT 4490 WATERTOWN ROAD <br /> -FII,E NO. 2355 <br /> WHEREAS,Susan and Douglas Van Moorlehem and Kenneth Turnham(hereinafter <br /> the "subdividers") on March 24, 1998, filed a formal subdivision application with the City for <br /> approval of a four lot residential plat of property legally described as: <br /> (Exhibit A, Attached) <br /> (hereinafter "the property"); and <br /> VVH�REAS, after due published and mailed notice in accordance with Minnesota. <br /> Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono <br /> • Planning Commission held a public hearing on April 20, 1998, at which time all persons . <br /> desiring to be heard concerning this application were given the opportunity to speak thereon; <br /> and <br /> WI�REAS, at said April 20 meeting the Orono Planning Commission on a vote <br /> of 6-0 recommended approval of the proposed plat subject to a revision to a 3-lot plat rather <br /> than 4 lots, to which the subdividers agreed; and <br /> WHEREAS, at their regular meeting held on May 26, 1998 the Orono City <br /> Council considered the subdivision application of the subdividers noting the following fmdings <br /> of fact: <br /> 1. The property is located within the RR-lA Single Family Rural Residential. <br /> � � Zoning District requiring a minimum of five acres�of dry buildable land within � <br /> each newly created lot. . <br /> 2. The property contains a total of appro�mately 35.65 acres of land, of which <br /> approximately 18.01 acres is dry buildable land and approximately 17.65 acres <br /> is wetland. <br /> �• Page 1 of 7 <br />
