PRACTICAL DIFFICULTIES DOCUMENTATION FORM <br />LA26-000006 <br />1. The property owner proposes to use the property in a reasonable manner not permitted <br />by the Zoning Chapter. <br />Response: 3a. The average lakeshore variance request is residential in nature and is reasonable <br />considering the unique nature of the Property as a large peninsula on the lake. The relatively large <br />flood hazard area and existing property placement create difficulties for improvements to long existing <br />structures <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />Response: 3b. The location of the structures on the Property and configuration of the lot was not <br />created by the property owner <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Response: 3c. The addition location within the average lakeshore setback will not alter the character <br />of the neighborhood. The addition will not impact views from the lake, nor will it appear to be more <br />visually relevant than the existing bay window and deck <br />4. Economic considerations alone do not constitute practical difficulties if reasonable use <br />for the property exists under the terms of the Zoning Chapter. <br />Response: 4. Economic considerations have not been a factor in the variance approval <br />determination. <br />5. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br />for solar energy systems. Variances shall be granted for earth-sheltered construction as <br />defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this <br />Chapter. <br />Response: 5. This condition is not applicable <br />6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br />use that is not allowed under this Chapter for property in the zone where the affected <br />person's land is located. <br />Response: 6. This condition is not applicable, as the condition of an existing residential dwelling <br />remains and is allowed conditional use in the LR-1A District. <br />7. The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Response: 7. This condition is not applicable <br />8. The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property. <br />51
