The property at 2165 NSD, located <br />across the bay, is the only adjacent parcel used to calculate <br />the average lakeshore setback. The home on 2165 NSD is <br />approximately 170 feet from the ordinary high-water level <br />(OHWL). Pursuant to City Code, new improvements must be <br />located equal to or farther from the lake than the principal <br />structure on 2165 NSD. <br /> <br />The existing home on the subject property is located as close <br />as 46 feet from the OHWL. However, the proposed additions <br />and improvements are situated no closer than <br />approximately 105 feet from the OHWL. While this location <br />remains within the calculated average lakeshore setback, <br />the proposed improvements would be substantially farther <br />from the OHWL than the existing structure. <br /> <br />Exhibit D, and the figure on the right, show the legal building area outside the average lakeshore setback (in <br />yellow). <br />46
