The Orono Plaruung Coirunission reviewed this application on May 18, 1998 and <br /> recommended approval by a vote of 3 to 2. � <br /> 4. The Planning Coinmission made the following findings of fact: <br /> A. The zoning lot does not meet -the minimum lot area or lot width <br /> requirements for the LR-1B district. <br /> B. The existing house is 160' from Shadywood Road and is located in both <br /> tlie 0-75' and 75-250' setback. <br /> C. The existing residence is 87' froin the 929.4' elevation for Lake <br /> Minnetonica and 8' from the channel. <br /> • D. The proxiinity to the channel is a hardship due to boat traffic noise. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect tr�c conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the' spirit and • <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 6. The City Council has considered this application including the findings and <br /> recommendations,of the Planning Commission, reports by City staff, corrunents <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the commutiity. . :. <br /> CONCI,i1SI0IVS, O1�D�R AND CQI�DITIONS <br /> � Based upon oiie or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoiiing Code Section 10.22, Subd. 2 and Section 10.56, Subd. <br /> 16 (L) 1 and 2 to permit the construction of a lakeside deck as proposed in E�ibit A where <br /> 4,818 sq. ft. (19.08%) hardcover exists in the 0-75' setback where a 19.5' x 17.66' (344.37 sq. <br /> • ft.) section of the badminton/sport court will be removed to allow 37 sq. ft. (17.86%) is <br /> proposed and none is allowed; and where 3,672 sq. ft.�(39.70%) of hardcover exists in the 75- <br /> 250- setback where a 2.5' x 17.66' (44.15 sq. ft.) section of the badmintoi�/sport court will be <br /> Page 2 of 5 <br />
