Date: March 9, 2026 Item: 9 <br />Presenter: Adam Edwards, City Administrator / Engineer <br />Section: Consent Agenda <br /> <br />Title: Easement Approval - Smith Avenue Cul-de-sac <br /> <br /> <br />1.Purpose: <br />The purpose of this council action is to accept easements for right of way and utility purposes at <br />the Smith Avenue cul-de-sac and authorize compensation to the property owner for the same. <br />2.Background: <br />In 2020, the city received a permanent easement from the property owners of 45 Smith Avenue for <br />the construction of a cul-de-sac. The cul-de-sac was constructed as part of the 2020 Road Project. <br />The easement was never recorded with the County. The property has a new owner who is looking <br />to complete an addition to the existing home. The easement impacts the building envelope and <br />setbacks related to the proposed addition. <br /> <br />City staff has partnered with the property owner to execute new easements that protect the city's <br />roadway and utility rights in a manner that mitigates the setback issues for the home. The original <br />easement was a singular right of way easement based on a 50-foot cul-de-sac radius. The new <br />easements consist of a right of way easement based on a 42ft radius of the cul-de-sac with an <br />additional 10-feet of drainage and utility easement. The city's zoning code measures the front <br />setback from the proposed right of way line from the 2020 easement. Reducing the right of way <br />by 8-feet will provide relief to the required yard, allowing the owner to site his addition and meet <br />the front setback, while still protecting the space around the cul-de-sac with a 10-foot utility <br />easement. <br /> <br />Once signed the easement will be sent to Hennepin County for recording. <br />3.Cost: <br />As part of the creating the new easements the resident agreed to complete the necessary survey <br />work for the easement documents and the city agreed to have the city attorney prepare the <br />easement documents. The city will compensate the property owner $2,000 for the surveying <br />expenses and to secure the easement. The streets operating budget will be used to fund the <br />compensation. <br />4.Staff Recommendation: <br />Staff recommends acceptance of the easements and approval of $2,000 as compensation to the <br />property owner for the easement. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to accept the easements for the Smith Avenue cul-de-sac and authorize $2,000 in compensation <br />to the property owner for the easement. <br />Exhibits <br />A.
