238578v1 <br />ORDINANCE 321 <br />CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING SECTION 5.20.320 (d) OF THE CITY CODE <br />REGULATING SOLID WASTE COLLECTION RATES AND FEES <br /> <br /> SECTION 1. Section 5.20.320 (d) of the Orono City Code is hereby amended by adding <br />the underlined language and deleting the strikethrough language as follows: <br /> <br />(d) Each applicant shall file with the city clerk, before a garbage and refuse hauler's license <br />is issued or renewed, a schedule of proposed rates to be charged by him during the <br />licensed period for which the application is made. The schedule of proposed rates, or a <br />compromise schedule of rates, shall be approved by the council before granting the <br />license. Nothing in this subsection shall prevent a licensee from petitioning the council <br />for review of such rates during the licensed period, and the council may likewise <br />consider such petition and make new rates effective at any time. No licensee shall <br />charge rates in excess of the rates approved by the council. <br /> <br />Rates and fees must be filed annually. Haulers must itemize base collection <br />charge, cart rental fees, taxes, environmental fees, fuel surcharges, and any other <br />charges. Rate increases require 60-day written notice to customers and City. <br />Volume-based pricing required. <br />1) All residential garbage service shall utilize volume-based pricing. <br />2) Each licensed hauler shall provide, at minimum: <br /> Small cart (30–35 gallons), <br /> Medium cart (60–65 gallons), and <br /> Large cart (90–95 gallons). <br />3) Pricing differential requirements: At least 25% between adjacent cart sizes <br />and at least 50% between smallest and largest cart. <br />4) Rates must encourage waste reduction consistent with county funding policy <br />and objectives. <br />5) Haulers must provide cart size data annually to support county reporting <br />requirements. <br /> <br />SECTION 2. Effective Date.
