Any licensee found to have violated this article, or whose employeeshallhaveviolatedthisarticle, shall be charged an administrative fine pursuant to a penaltyscheduledeterminedbythecityandpublishedinthefeescheduleadoptedbythecitycouncilataregularlyscheduledcouncilmeeting. In addition, after the second offense,thelicenseshallbesuspendedfornotlessthanthreedays. After the third offense, the licenseshallbesuspendedfornotlessthansevendays.b) Employees of licensees and other individuals. Any individual 21 years of age orolderwhoisfoundtobeinviolationofthisordinancemaybesubjecttoanadministrativefinenotexceedingfiftydollars ($50), or may be required to complete an instructionalprogramontherequirementsofthetobaccoretaillicensingordinance, at the expense of thelicenseholder.c) Misdemeanor.Nothing in this section shall prohibit the city from seekingprosecutionasamisdemeanorforanyviolationofthisarticlebyaperson21yearsof ageorolder.Ord.
