Purchase, Use, and Possession (PUP) Penalties <br />●A city’s tobacco ordinance and associated resources should focus on <br />retailers, not those who use commercial tobacco. <br />●There is no strong evidence that PUP penalties are effective in significantly <br />reducing youth smoking. <br />●Historically, PUP laws were lobbied for by the commercial tobacco industry <br />to punish youth users while the industry simultaneously targeted and <br />addicted youth. <br />●PUP penalties could open the door to selective enforcement against youth <br />from certain racial, ethnic, and socio-economic groups. <br />●Bottom Line: Cities that currently have PUP penalties no longer <br />aligning with state law should consider removing those penalties <br />from their ordinance. <br />53
