City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO <br />8. At that same neeting the Orono City Council directed staff to <br />prepare a resolution of approval for Applications 991 and. 1018 <br />and to include the following findings in that resolution: <br />A) The alt-rations proposed in t..he lagoon area (Area 1) <br />involved ro major changes in elevations or in local <br />drainage. Tnis type of filling is typical where new ground <br />cover is to be installed. Applicant maintained adequate <br />erosion control thoughout entire restoration. <br />B) The alterations proposed within 75 feet of the lake to <br />permit the installation of the foundation ground water <br />drainfield as proposed in plan by Mark S. Gronberg referred <br />to as Drain Ti le De,ails (Area 2) and as am`-ided by Glenn. <br />Cooksreport dated J ine 2, 1986 is found to t,e superior to <br />drainage al lowed to surface on ground] to col lect sediment, <br />fertilizers ind other debris. <br />C) The berminq rlorq Bohn's Point Road right-of-way (Area <br />3) as approved by Council will be consistent with the height <br />of a 11 a l l owed man-made i mprovement s a l ong t he st reet 1 of <br />line of lakeshore lcts adjac-ent to minor thoroughfares and <br />such improvement wo,ild he consistent with the intent and <br />guidelines for all de-velopmcnt within larvshore rpsilpntial <br />Ali stricts. <br />D) The filling within tte corridor along the shared lot <br />line of the property (Area 4) providers more uniform or <br />flatter grades providing a more suitable treatment area for <br />surface drainage rather than the more extreme elevations <br />approved at the time the building permit was approved. The <br />east 1/3 of the property now drains to a pon-i before <br />enterinq the main. lake. <br />9. The City Counci l finds that the conditions existing on this <br />property are peculiar to it rind do not apply generally to other <br />property in this zoning district; that granting the variances <br />would not adversely affect trAlfic condition%, light, air not <br />pose a fire hazard or of `ier danger to neighboring properties; <br />would not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a dt-monst.able hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />.applicant; and woull be in keepinq with the spirit r:d intent of <br />the Zoning Code and ccmprehens i ve I' 1 an of the City. <br />Page 3 cf 6 <br />
