In one particular 1595 Bohns Point Road <br />case, hardship had not been demonstrated due to the (Continued) <br />fact that the homeowner had not lost riparian rights <br />to the lake, and therefore, had not had approval for <br />dredging. <br />Councilmember Massengale stated that Mr. Dunlap does <br />have riparian rights to the lake and that no hardship <br />has been demonstrated. <br />Councilmember Paurus explained the LMCD's regulations <br />and position regarding riparian rights for maintenance <br />dredging. <br />Massengale moved, Butler seconded, to table the <br />above request and instructed staff to redraft a <br />proposed resolutiDn clarifying point of controversy <br /># 24 <br />stating facts on policy regarding dredging. Motion, <br />Ayes (5) - Nays (0). <br />Mr. Alan Olson, City Planner, entered into the recoir� VAPT.ANCE <br />the request of James DeSplinter, 1121 Elmwood Ave-_uf., 1121 Elmwood Avenue <br />for renewal of a variance application, dated Octob%r 17, #430 <br />1978, which states: James DeSplinter <br />Mr. DeSplinter's original variance application wa- <br />aporoved by Council on January 10, 1977. His new <br />plan shows the house meeting all setback requirement3, <br />but the garage is setback 11' from the road. Staff <br />required the unused road access of 20' width be <br />staked by the surveyor.
