City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1791 <br />5. The City Council finds that granting a Conditional Use <br />Permit to allow the guest apartment to be constructed within <br />the detached garage structure will not be detrimental to the <br />health, safet or general welfare of the public, would not <br />adversely affect light, air nor pose a fire hazard or other <br />danger to neighboring properties, nor wil: it depreciate <br />surrounding property values and the proposed le ✓el of use of <br />the prof erty wi 1 1 be in keeping with the intent and objec- <br />tives of the Zoning Code and Comprehensive Plan of the City. <br />CONCULSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />hereby grants a Conditional Use Permit per Municipal Zoning Code <br />Section 10.20, Subdivision 3 (G) to permit a guest apartment <br />within the detached garage on the property, subject to the <br />following conditions. <br />1. Guest apartment located within the second f loor of the <br />detached garage may never be rented, but is for the ex- <br />clusive use of owners, their guests ar their employees. <br />2. The guest apartment must be served by an independent <br />sewer connection to the municipal line. <br />3. Violation of or non-compliance with any of the items and <br />conditions of this resolution shall constitute a violation <br />of the Zoning Code, shall automatically terminate any <br />authority granted herein, and shall be punishabl^ as a <br />misdemeanor. <br />4. The undersigned owner has read, understood and hereby <br />agrees to the terms of this resolution and on behalf of <br />himself, his heirs, successors and assigns, hereby agrees to <br />the recording of this resolution in the chain of title of <br />the property. <br />Adopted by the Orono City Council on this eth day of <br />July, 1985. <br />ATTEST: <br />oYtothy M: allin,'City Clerk Mary C.
