Easement Vacation <br />Exhibit D - Proposed Resolution for Prelimianry Plat Approval <br />DISCUSSION <br />This is a request to replat Lots l and 2 of "Brooks Green", originally <br />platted in 1980. The new building site created at. that time was never <br />developed, and the Boyke's wish to re -arrange the lots to allow for a more <br />attractive house site on Lot. 1. <br />The arrangement recommended for approval by Planning Commission <br />includes the following pertinent facts: <br />a) Drainage and Utility Easement along the lot line between the <br />existing Lots 1 and 2 is recommended to be vacated in favor of new <br />drainage and utility easements to be granted along the new dividing <br />line. <br />b) .A 30' access corridor will be platted as part of Lot 1 along the <br />south end of the property, to provide access to the priv?te easement <br />road known informally as "Lydiard Road". Lot 1 becomes a "flag lot". <br />c) A 1/4 portion of a 50' - radius cul-de-sac will be platted at the <br />southeast corner of the property, dedicates] for future road purposes <br />(no commitment to public or private). <br />d) Applicant proposes to use an extention of the exi-sting driveway <br />serving Lot 2 to access to Lot 1, where he intends to build in the <br />northeasternmost part of the required building envelope. Planning <br />Commission was satisfied that the driveway could be constructed and <br />used without creating a problem for either Lot 2 or the Hollander Road <br />neighbors. <br />e) A small portion of the pond east of the existing driveway is <br />within the property, and is a designated wetland, hence shall require <br />a conservation and flowage easement. <br />f) Sites for primary and alternate drainfield systems have been tested <br />and approved for each lot. <br />Staff recommends approval of the attached preliminary plat resolution <br />and easement vacation resolution (easement vacation will not be filed until <br />final plat is approved.) Two separate motions would be appropriate. <br />
